European Law the Ordinary Legislative Procedure

n European Law the Ordinary legislative procedure is used when drafting hard law to ensure that the democratically elected representatives of the EU citizens have an equal say in appropriate areas of law making. There will be a brief analyse of the Ordinary legislative procedure and a discussion on it. European Law is very complex law , within EU law there is various different treaties which are in place. Two most significant treaties which have importance to the legislative process are The Treaty on European Union and the Treaty on the functioning of the European Union.The Treaty on European Union also known as the Maastricht Treaty was signed in Maastricht 7th of February 1992 and the Treaty on the functioning of the European Union also was known as the treaty of Rome until the Treaty of Lisbon came Enforce and changed it’s name , the original Treaty of Rome was signed in 25 March 1957. These two treaties have effect on the constitute of the Union , and in effect these two d ocuments had all ready created a Federal State which was recognised by the European Court of Justice this was before the Treaty of Lisbon as put in place.Within EU there are two types of Legislation Primary and Secondary. Primary legislation is the ground rules or basis which is set out in the treaties. Secondary Legislation includes regulations, directives and decisions these are derived from the principles and objectives set out in the treaties . The EU’s standard decision-making procedure is known as ‘co-decision'. This means that the directly elected European Parliament has to approve EU legislation together with the Council.The TEU established the co-decision procedure , this provided the European Parliament with new powers of amendment and right to reject legislation. This procedure was carried on through out all the treaties , however the Treaty of Lisbon renamed the co-decision procedure to the ordinary Legislative procedure. The ordinary Legislative procedure i s highlighted in article 294 of the TFEU. The ordinary Legislative Procedure must be applied wherever the legal base provides that an act shall be adopted â€Å" in accordance with the ordinary legislative procedure† (art 294 (1) TFEU. The procedure begins with the commission submitting a proposal to the European Parliament and the council. The commission also take into account since the treaty of Lisbon they must also propose this forward to the national parliaments this can be seen in protocol 1 and 2 of the TEU. The next stage is the first reading and normally the first reading is by the European parliament. First Reading The parliament decides whether or not to view the proposal which was made by the commission , the parliament then contacts the council and tells them its view of the proposal.Then there are two possibilities which can arise: If the council approves the Parliament’s position , the council , acting by qualified majority , shall adopt the act concerne d . The wording of the act will correspond to the position of the parliament ( art 294(4) TFEU);. If the Council does not approve the Parliament’s position , the Council , acting by a qualified majority ; shall adopt its position and communicate its position to the parliament and communicate its position to the parliament (art 294(5) TFEU. The Council shall inform the Parliament fully of the reasons why it adopted its own position at first reading (art 294(6 TFEU). This will obviously include reasons as to why the council has rejected the Parliament’s position. The commission shall also inform the Parliament fully of its position (art 294(6) TFEU). The first reading of legislation is very length and time consuming. When the council disapproves of the legislation instead of going straight to the commission who projected the future piece of legislation they report back to the Parliament then vice versa .This is making this process very complex as instead of doing two ste ps this could be easily completed in one ,the Council could just report back to the commission and this would make this process so much more effective This would also allow the hard law to be implemented quickly so they can take direct effect within the EU. Second Reading The Parliament has three months from their first initial contact with the council about the commissions proposal for legislation if they have not came to a decision whether or not to carry on with the proposed legislation or agree with the Councils view on it .Then the council will be deemed to adopt the act in accordance with its position Art 294(7)(a) TFEU. The Parliament can take different approaches within the three month timeframe. The Parliament can reject the Council’s perception if they do so then the act would be considered not to have been implemented. This is known as veto and prevents the bill becoming law. However in order for this procedure to take place there must be a majority vote of the com ponent members of parliament.Or they can vote an majority vote to propose the amendments of the future legislation which the council has proposed. In my opinion I think that it is beneficial that the parliament can chose to make the law veto as personally the parliament members are for the citizens of the European Union therefore as they have the power of veto then they can ensure fair and effective legislation is introduced into Europe and not just any old law which is only really benefiting members of the Council.Although in order to make the law veto there must be a majority which I personally don’t think its fair as alias are likely to stick together ie France, Germany etc normally side with each other these major European countries hold the most power in central Europe therefore this can have an major effect on the smaller countries like Malta. The smaller countries may be forced to implement law which they did not agree to , but due to the majority vote it will have to be implemented or the proposed piece of legislation which would benefit them significantly may be rejected.Once the parliament amends the piece of legislation it then has to be agreed by the European parliament members, the amendments are then sent to both the Council and the Commission. The Commission then looks over the draft piece of legislation and looks particularly at the amendments and they liaise with the parliament giving their opinion of the amendments which the parliament made. The Council has a different role in regards to the amendments.They Council does not give there opinion but merely can reject all amendments , accept all amendments , or accept some amendments and reject others. This stage is unnecessary personally because the commission has all ready give their opinion of the legislation as they came up with the idea to create the legislation and generally have a outline of what the legislation should consist of , although it does have its Also the Council has also gave their own opinion in the first reading.The Parliament has a huge work load because of this as they are continuingly asking for opinions and are constantly having to change the draft to suit the Council and Commission. This can have a huge effect to the hard law within Europe as countries can choose to opt out of specific pieces of legislation , as the Council , EP and the Commission would be continuously back and forth with opinions trying to make the law suit every member state.For example when the Treaty of Lisbon was first introduced Ireland refused to sign it and because of this it resulted in a second referendum being conducted in 2009. Also Czech Republic negotiated an opt-out from the Charter of Fundamental Rights of the European Union. Personally in my own opinion this is not fair allowing countries to opt out of certain pieces of legislation or treaties. This defeats the purpose of the EU being established. The European Union was created to ensure fairness , equality and satiability within Europe and try to unite Europe as one.Allowing countries to opt out is not creating a fair and equal Europe it is simply just allowing member states to do things their own way to suit themselves. Generally I believe that the majority of EU members do not take the time and consideration to review the law that is being presented to them and how this could actually benefit or effect the citizens that they are suppose to be representing at times I feel members of the EP , Commission and the Council only think about themselves and how it could effect them not the citizens.The Council must act within 3 months of receiving the amendments from the parliament. The council approves all the amendments of the Parliament acting;(i)by a qualified majority if the Commission has also accepted all the amendments; (ii) by unanimity if the commission has rejected all the amendments or (iii) by a mixture of the two if the Commission has accepted some (qualified majority) an rejec ted others (unanimity) in this case the act is deemed to have been adopted (art 294(8)(a) and 294 (9) TFEU)If the Council does not want to approve all the change in the act , then in this case the President of the Council and the President of the European Parliament must liaise with each other and come to an agreement and conduct a meeting of the Conciliation Committee within the six week time period. This is highlighted I ( art 294(8)(b) TFEU) Conciliation Committee The conciliation committee of an equal amount of members from the council and also an equal amount of members from the European parliament.There aim is to agree on the draft piece of legislation which was conducted , within the second reading and come to an agreement of how the legislation should be written. However there must be a majority vote of both the EP and Council members. The commission also takes part in the discussions and â€Å" shall take all necessary initiatives with a view to reconciling the positions o f the European Parliament and the Council† After the meeting with the Conciliation Committee there are two possibilities which could occur: The EP and Council can agree with the joint test and then the act Would be deemed to be adoptedHowever a third reading of the act may be required this is seen in Article 294 (13) & (14) TFEU. In this article it explains what the third reading consists of , according to the article it states â€Å" if , within that period , Conciliation Committee approves a joint text , the European Parliament , acting by majority of the votes cast , and the Council, acting by a qualified majority , shall each have a period of six weeks from that approval in which to adopt the act in question in accordance with the joint ext. If they fail to do so, the proposed act shall been deemed not to be adopted. Section 14 relates to the time frame the EP and Council has ; â€Å" The period of three months and six weeks referred to in this Article shall be extended by a maximum of one month and two weeks respectively at the initiative of European Parliament or the Council. This third reading yet again is simply another procedure which is not required although if both the EP and the Council cannot agree , where do you go from there? Personally I think there should be more stricter rules when creating legislation , especially when the council needs a majority vote , this is making the process a more lengthy procedure as the Council may be agreeing to adopt the law but because there is no a majority vote it has to go for a further reading. The ordinary legislation suggests in its integrity suggests a common procedure however this is not the case this , procedure is very complex and time consuming. Generally I feel this process contradicts it’s self completely.The European Parliament is demanding more powers from the Council but the Council is not willing to accept these demands. However it is made apparent in article 296 TFEU that the Parl iament can choose to make the law veto , but cannot demand for the amendments they have made to the draft to be accepted. Therefore the Parliament must either accept or reject the amendments , which completely defeats the purpose of common procedure . Once the EP makes the law veto the its back to square one again.To conclude personally I feel that the ordinary legislation procedure for European Law is very complex and contradicts its self in so many ways. Therefore I do not think it is a very effective way to create hard law as the parliament can choose to make the law veto however cannot reject all amendments , is this not just making the law negative ? In this section of the article section (8) subsection A states â€Å" approves all amendments , the act in question shall be deemed to have been adopted. † this basically means that if the Council accepts the changes to the legislation within the second reading then it can become law and be implemented.Article 294 section 9 states that â€Å"the Council shall act unanimously on the amendments on which the commission has delivered a negative opinion† this section suggest that the Council can accept some amendments and reject others by this must be agreed by everyone. A Field Trip to Dell, Inc. Website

This is one business in the United States where IT is the center of commerce, and people are in constant interaction with technology.Background & PurposeThe writer has made a field trip to Dell, Inc.’s business website early at around 6 am on the 7th day of August 2007.   I chose this site because Dell, Inc. has basically been one of my favorite brands when it comes to computer hardware products like personal computers, servers, software, data storage devices, and personal digital assistants.   Dell manufactures even my PC, so instead of going to Round Rock, Texas where its headquarters are presently located, I used IT and the media to connect to the company and make a ‘virtual’ field trip.My purpose here is to evaluate five things: first, the purpose of the website; second, the assumed user profile; third, the psychological and social human habits that are reflected in their website design; fourth, the advanced technology or technologies that they use; fifth, the way media visitors interact with technology; sixth and last, whether the technology affects cultural and social interactions.   What I should be careful to observe are the physical and human environments that are good precursors of interpersonal relationship.FindingsFrom my virtual field trip on Dell, Inc., my findings can be described as follows:1.  Ã‚  Ã‚  Ã‚  Ã‚   The purpose of the website is multi-faceted, although the overall function of the site is to inform people about their company, their business, their products, the events that they have, and the benefits of choosing them as a computer manufacturing company.2.  Ã‚  Ã‚  Ã‚  Ã‚   The assumed user profile revolves around high-tech visitors of big suburban cities around the world (the Western, most especially).   It appears from its website design that the major group of people that are being invited to enter are those that are from the middle age, middle class society mainly because of the simplicity of design, some picturesque views, and a group of middle-aged, middle class people that are shown interacting.   Business investors are also included in this virtual user profile.3.  Ã‚  Ã‚  Ã‚  Ã‚   The psychological and social human habits that are reflected in their website design constitute the concepts of simplicity, brotherhood, purity or creed (The Soul of Dell), being environmentally friendly, and the magnitude of technology.4.  Ã‚  Ã‚  Ã‚  Ã‚   The advanced technologies that the company use can be subdivided into the following categories: first, the high-tech marketing information systems; second, the ultra-modern system of computer product manufacturing; third, the use of digital equipment for customer and human resource management; fourth, the use of ‘virtual integration’ and ‘fast-cycle segmentation’;[1] fifth and final, the ongoing use, innovation and improvement of Dell computer and its digital technology.5.  Ã‚  Ã‚  Ã‚  Ã‚   Media visitors of t he Dell, Inc. website interact with technology from the start of the virtual tour up to the end.   Each buttons that they use in their personal computers bring them to a different tab or window in their screens, and all these can be labeled as interactions with technology.6.  Ã‚  Ã‚  Ã‚   Based on my virtual tour at Dell, Inc. website, it is very obvious that technology affects cultural and social interactions.   Companies have the power to reflect cultural, social, and psychological views in the designing of their websites, in the laying out of fundamental ideas and codes, and in the types of information that are being shown.ConclusionsBeforehand, it was my preconception that Dell, Inc.’s physical and human environments would only revolve around the higher-class society of the Western world.However, based on the front picture on their website, the city that is shown does not necessarily pertain to the Western world but any city around the globe that is high-tech and vi rtual.   From brown hairs to black, the only thing that is similar among the people that were shown in the web pictures was that they were all high-class and contemporary.   Human habits depict one that is globally interconnecting, with a concern for earth and brotherhood.This visit changed my views by revealing that IT does not simply interact with people as a whole but that it connects with every viewer by reflecting significant psychological and social human habits that are most appealing for a given time and environment.   As of now, the environment covers the global spectrum because we are in the digital age, and the only American emblem that we see is the small flag of the USA.   Technology has the power to affect cultural and social interactions by affecting interpersonal relationship at best.SpeculationIt is my speculation that cultural and political wars do not help virtual companies like Dell, Inc..   This is because the overall concept that is readily seen in th eir website is one on concord and brotherhood.   The company has to ignite a very positive aura in the media, yet with all these they should also be true to their country as well.   To be a virtual company is to be clever both in social and interpersonal relationships inside and outside the country.ReferencesDell, Inc.   (2007).   Company: about Dell.   Retrieved August 7, 2007, from http://www.dell.com/content/topics/global.aspx/corp/en/home?c=us&l=en&s=corp&~ck=mn.Magretta, J.   (1998).   The power of virtual integration: an interview with Dell Computer’s Michael Dell.   Harvard Business Review, March-April, 73-84.[1] This makes use of the most sensible timesaving devices, such as customer focus, supplier partnerships, mass customization, and just-in-time manufacturing.

Cadbury: the Study of Consumer Behaviour

†There's one product that sells in good times and bad – a bar of chocolate†. It has been an axiom of Cadbury Company for generation. Today, the company which was opened in 1842 by John Cadbury, Is the global leader in the chocolate confectionery manufacturer. The beginning of Cadbury journey is when John Cadbury opened up a shop in Birmingham and sold coffee, tea, drinking chocolate and cocoa. In the later stage, John’s brother Benjamin joined the company in 1842 and opened an office in London and received Royal Warrant as manufacturer of chocolate and cocoa to Queen Victoria in 1854. After six years, John got problem about his health and his wife was death so they left their business and company to their sons George and Richard. The brothers was also dissolved their partnership at the same time. George and Richard continued to develop the product line, and by 1864, they were getting an early profit. By this time, Cadbury’s Cocoa Essence which was an all nature product with pure cocoa butter and no starchy was introduced to people. After which, the brothers soon moved their manufacturing operations to a larger facility four miles south of Birmingham and the factory and area was known as Bourneville. With a success in chocolate, George and Richard stopped selling tea in 1873 and master confectioner Frederic Kinchelman was appointed to share his recipe and production secrets with Cadbury workers. Moreover in two years time, the factory employed more than 2,600 people and was incorporated as a limited company. In 1969 Cadbury merged with Schweppes which was a large British brand that supply mineral water and soft drink and the company was know at Cadbury Schweppes. The merged companies would go on to acquire Sunkist, Canada Dry, Typhoo Tea and more. Schweppes Beverages was created, and the manufacture of Cadbury confectionery brands was licensed to Hershey. Today Cadbury Schweppes is the largest confectionery company in the world, employing more than 70,000 employees. In 2006 the company had over $15 billion in overall sales. In March of 2007, Cadbury Schweppes announced that it intends to separate its confectionery and beverage businesses. With almost 200 years in the business, Cadbury Schweppes will continue to prosper in the coming decades. Theories Used The whole paper will discuss about the model of motivation, arousal of motives , hierarchy needs of Maslow’s, ELM (elaboration likelihood model ) and how these theory and model apply to the improvement and expansion of Cadbury company to better understanding about their consumer behavior. First of all, motivation is basically defined as the driving force within individual that impels them to action. According to the model of motivation process (Schiffman et al, 2008), when people need, want and desire are unfulfilled, they tend to feel tension. After that it will drive people to the direct behavior through their thinking process and previous learning until their need is fulfilled (Schiffman et al, 2008). On the other hand, most of people specific needs are dormant much of the time. The arousal of any particular set of needs at a specific point in time may be caused by internal stimuli found in our physiological condition or our emotional or our cognitive process or by external stimuli in environment (Schiffman et al, 2008). One of the well know theory of human motivation was developed by Abraham Maslow which interpret how customer perceive satisfaction about goods and service at different level of needs. According to Maslow, there are five basic level of needs which are physiological needs; safety and security needs; social needs; ego needs; self-actualization. The theory is showed that human seek for the satisfaction from lowest level first (physiological) such as food, water, air, clothing, sex. After the first level of needs is satisfied, people will seek to higher level of needs which is safety and security needs. After they get these needs, they will look for the social needs such as love, affection, belonging and acceptance and then is ego needs and self- actualization. (Schiffman et al, 2008) The elaboration likelihood model proposes the more global view that consumer attitude changed by two distinctly different routes to persuasion: a central route and a peripheral route. When consumer‘s motivation or ability to assess the attitude is high, their learning and attitude change tend to occur via central route with available information about the attitude object. In contrast, when people’ s motivation or assessment skills are low, learning and attitude change tend to occur via the peripheral route without the consumer focusing on information relevant to the attitude object itself. (Schiffman et al, 2008) Maslow’s Hierarchy of Needs According to Hassan (2005), Maslow’s hierarchy of needs includes physiological needs, safety and security needs, social needs, ego needs and self-actualization which can help us to understand human behavior and have a right point to motivate customers power purchasing, especially for what Cadbury has been applied for their segmentation strategies and positioning strategies. First of all, as we know that chocolate is belonged physiological needs which means this kind of product is low price and more competitive so that there need have a successful key to become the second largest confectionary market after Marks-Wrigley (Conor Carroll 2009). This is the brand of itself because when customers try whatever product they always concerned about the brand name which not only help the customers identify their needs and satisfy product but also help the marketers to become different from their competitors. For this company which already have a strong brand and strong history from 1824 (Conor Carroll 2009) which is more powerful to get customers trust and remained loyal customers as well. For example, when a person go to the super market and he wants to buy a soft drink immediately he will think about Coke or Pepsi, as like as in this case when he go to the supermarket and he wants to buy a bar chocolate he may think about Cadbury although the price may higher than others brands but because of the high reputation and quality brand so that consumers will pay a higher price for branded product which they believe it provides a higher value. Secondly, although Cadbury is a second largest confectionery company it still made a mistake when they did not concerned a lot about safety and security needs of consumers in 2006. According to Conor Carroll (2009), Cadbury be in scandal of salmonella scare in 2006 and Easter chocolate products scandal in 2007. Because of it, Cadbury reputation and benefits at this time was dropped significantly. However, they had fined by the Food Safety Authorities and need to recall the entire products problem. As a result, Cadbury get over the big two trouble and got it meaning lessons for safety and security products. However, it not only stops by there, they already have an action to get back their reputation from consumers by support more laboratory facilities and scientists to test the product quality and more involve in the social responsibilities. Cadbury is not only use the campaigns to encourage their customer’s social consideration but also has a special strategy to stimuli their farmers and workers such as give more bonus and benefits to the workers in Ghana and support the people living around. This is meaningful that when consumer try Cadbury chocolate they may think that they already pay a right price which bring the benefits to the workers and also contribute a small part to support the society. As a result, this is the best idea for the marketers because when you want to have a strong brand name inside consumers mind you need to concerned more about the social and environment which are the strong strategy to maintain the product brand name and Cadbury did it. Next, some of the Cadbury products and advertisements emphasis the ego needs which is more specific on self-acceptance and self-esteem such as Cadbury already have targeted this concept to teenagers like Cadbury Perk. For this strategy, Cadbury Perk was targeted to the casual snacking which includes chips and wafers. Moreover, Cadbury Perk contains a message that whenever and wherever teenagers need it always available for their convenient it becomes a new mini snack in this market. Furthermore, for the confectionery market teenagers and children are the majority consumption and the most important of segmenting and positioning. When the teenagers try Cadbury Perk they may feel like this product was born for them and stands for them like young, active and creative life. (Cadbury PLC 2010) Lastly, there is need for self-actualization which is concentrated more on inner thinking such as psychological integration or demand higher level of personal potential. Hassan (2005) states that generatively, social justice and transformative thinking should be cooperate with this orientation. Thinking towards to Cadbury, we can see that they try to satisfy the customer’s needs as much as they can or even though more than what consumers expected like Cadbury celebrations which was aimed to replace the traditional gift options during festival seasons with a pretty box and nice packaging it really suit for gifting. It is different from others category because it is more formal and luxury which extend consumers needs. Moreover, Cadbury also have introduced a product for after dinner sweet which main targeting in India. Because in India people have a habit to have a sweet dessert after their dinner and this product can replace traditional sweet which inconvenient and take more time to repair. For this part, the advertisement more focuses on the adults rather than children. From this point, we can see that Cadbury not only segmenting and positioning their product on children but also expand their segmentation to the adults which called as potential customers. Certainly, in this point their advertisement and packaging are also be different from the product that they target to the children. Model of Motivation Motivation is a theoretical construction from which we can determine the driving force behind human behavior. (Kroeber-Riel and Weinberg 2003, cited in Wohlfeil and Whelan 2006) This, according to Weinberg (1995 cited in Wohlfeil and Whelan 2006), is a combination of both emotional and basic urges to direct behavior and cognitive process to direct the goals and drive to accomplish those goals. These goals differs also as the customer moves along the decision making process, as the needs and motivations changes will affect how the customer perceives any given information. (Mallalleu and Nakamoto 2008) In the case of Cadbury, the motivations of their customers who purchase their brand off the shelves in departmental stores will be different from those who purchase other brands of chocolate, depending on the segmentation, targeting and positioning of the brands, as they focus to fulfilling different groups of customer’s needs, wants and desire. Cadbury fulfills many market segments, ranging from milk chocolate, dark chocolate, chocolate flakes, chocolate powder, chocolate drinks and many more. By targeting many market segments, Cadbury aims to provide a sense of convenience, and variety within the same brand, lending the strength of their overall brand equity to all the brands under Cadbury. This benefits the customers as now they could purchase different products under the same brand, which they can be assured of the quality, packaging and taste, without having to take the risk of try other brands to purchase different chocolate products. Gale 1992; Smith and Park 1992, cited in Morgan and Rego 2009) Higher brand equity allows Cadbury to price their products at a slight premium, despite them competing within the low price segment of the chocolate industry. (Sivakumar and Raj 1997, cited in Morgan and Rego 2009) Cadbury also uses celebrity endorsements, such as Mr. Amitabh Bachchan in India, in order to regain brand equity after worms were discovered in Cadbury chocolates in India. (The Financial Express 2003) Although ultimately, it was later proven that the worms were caused by their retailers bad storage practices in India, their reputation was already tarnished. However with celebrity endorsement, the celebrity acting as a source lends credibility and attractiveness to the product, giving it familiarity in the process. (Sternthal and Craig 1973, cited in Biswas, Biswas and Das 2006) this motivates the customers by giving them the drive to purchase it when their favorite celebrity endorses the product, and through their cognitive process, any perceived notion of risk is significantly reduced. According to Rao and Monroe (1988), consumers are likely to process more information other than price if they are motivated, to determine the quality of a given product. This is important as Cadbury often creates contests and advertisements to build involvement in their products in order to motivate consumers to choose their brand. This involvement however only targets the people with specific personal relevance from which the product has on the person involved. Elaboration Likelihood Model (ELM) Customers can be motivated in many ways, but based on the elaboration likelihood model (ELM), two routes of persuasion are identified – central route and peripheral route (schiffman et al 2009). At the same time that integration planners must adapt HPs existing culture to unify the two companies, planners must also ensure that HPs culture remains focused around the key elements of the HP Way: trust, respect, achievement, integrity, teamwork, innovation, and an interactive work environment. Among the first-and arguably one of the most important-steps in integrating cultures is to determine what constitutes a good culture and then to base changes on those elements. According to HPs integration planning team, a good culture must: be clearly defined and broadly understood; reflect the business strategy and brand; support best-in-class performance with customers, partners, stockholders, and employees; produce alignment, commitment and excitement; establish a competitive advantage; and be reflected in the communications and actions of core leaders. Change models 1.Unfreeze, Change, Freeze Kurt Lewin proposed a three stage theory of change commonly referred to as Unfreeze, Change, Freeze (or Refreeze). Stage 3: Freezing (or Refreezing) Kurt Lewin refers to this stage as freezing although a lot of people refer to it as refreezing. As the name suggests this stage is about establishing stability once the changes have been made. The changes are accepted and become the new norm. People form new relationships and become comfortable with their routines.Its often at this point that people laugh and tell me that practically there is never time for this freezing stage. Staff: In staff employees and their general capabilities are included. Skills: Skills are the actual skills of the employees who are working for the company. Post merger The proposed merger consolidated HP Compaqs product into four groups customer services, imaging and printing, access devices, and information technology infrastructure. First of all, private education can be defined as an education where parents need to pay for rather than free education that was provided by the government. It is also known as an education that was provided by a private individual or organization, rather than by the state or public body. It means that it is not operated by the government. Private education often occurs among people who have high economy status. It has many private education institutions in our country and this education institutions is classified as private because it is controlled and managed by a non-governmental organization like Church, Trade Union or business enterprise or its Governing Board consist mostly of members not selected by a public agency. Usually this institution was established by the coalition of corporate bodies which make an investment towards these institutions. But many private institutions receive public subsidies especially in the form of tax breaks and students loans from the government. In the early 1990s, there were approximately 200 private colleges but no private university. But in 2011, there is exist 53 private universities including private university colleges, 6 foreign university branch campus and more than 500 private colleges. From this data we can see that the number of private institutions increasing rapidly from year to year. The number of private university is higher when we compared it with the public university. We can see the dumping of private institutions in our country compared to public institutions. Approximately 50% of the countrys total tertiary students enrolment population is in private higher education institutions. The increase in enrolment population within private higher education institutions demonstrated in staggering rise from only around 15 000 in 1985, to just about 35 000 in 1990 and just over 320 000 in 2005. The rank of private institutions can be classified based on its tier. Tier is known as a level of one institution is ordered. It has six tiers where tier 6 is the highest level and tier 1 is the lowest level. Tier 6 is known as outstanding and none of the private university in our country is classified in this tier. While for tier 5 it is categories as an excellent tier for example University Kuala Lumpur, University Technology Petronas and many more. AIMST University and University Tenaga Nasional is the example of university that in the tier 4 which is classified as very good. Tier 3 is classified as good and College University Insaniah is one of the universities in this tank. For tier 2 it is known as satisfactory and tier 1 is weak. It also has private stitutions that are not rated and it is because they do not have a specific place or their own building to make as a class. So it is hard for the government to give them the tier. DEFINES THE ISSUES PROBLEM FACED BY PRIVATE INSTITUTIONS It has many problems that private institutions need to face in term of preparing graduates, provide the facilities and serve the training to the students. It is because private institutions are fully operated by their own organizations without the helping from the government, so they need to find their own solutions to give the best services to their students. Students that enter to these institutions deserve to get the best services as they pay the expensive tuition fees. Therefore, private institutions definitely faced the problem in providing quality services to their students. The main problem that private institutions usually faced is in preparing the graduates. They have problem in prepared graduates that are able to compete globally and have entrepreneurship skills in the world of work. As we know in public institutions, students require to take the subject for entrepreneurship. It is because to provide students to be an entrepreneur in case that if they finish their studies and they still did not get work, so they can use the knowledge that they learn to build up their own business. But in private institutions, these subjects are not provided and not compulsory to the students to take this subject. So it is one of the problems that were faced by the private institutions in preparing good and quality graduates. Besides that, private institutions also have problems in preparing graduates that have good communications skills. As we know, usually many students that enter to the private institutions have low academic achievement and they do not get an offered to enter the public institutions and thats why they go to the private institutions. When they have low achievement in academic it is hard to develop good skills among them compared to high achiever students. It is hard for the lecturer to build a good communications skills among them. Students in private institutions also lack of moral values and disciplines. It is hard for the institutions to disciplining students because the rules and regulation is not too tight. Students are free to wear the clothes that they like and they can enter and skip the class whenever they want. Private institutions did not care about their students attendance and how their student dress. Because of that, the graduates from private institutions will lack of moral values compared to public graduates. They also lack of disciplines because they can do what they want and like in this private institutions that they pay for. The second problem that private institutions usually faced is in term of facilities. They cannot provide adequate facilities for students and this is because their spending was not enough and they need to buy all facilities for the teaching and learning process by itself. When they have inadequate facilities it will make their learning process not running smoothly and teacher cannot give their best services to the students. Facilities also the big problem that private institutions should face because equipment for learning is very important for students comforts. Private institutions cannot provide enough facilities because of inadequate financial. In addition, students also need to share the lab facilities when they are doing some research. It will make students feel uncomfortable when they need to share the equipment with their friends. Besides that, students also will lack of skill when they cannot do their research by their own. It also will limit students activities for example in doing research and as we know lab facilities is important for us to conduct some experiment. For students in higher institutions they need to conduct a research to make their learning process more effective and to make them more understand about some topic but when private institutions cannot serves enough facilities, their students learning will be limited. Financial problem is also the main factor why private institutions cannot provide enough lab facilities to their students because of the expensive price for lab facilities. Besides that in some private institutions it also has small classes. Classroom is the perfect place for the delivery of teaching and learning directly from the trainers to the students. Nevertheless, the extent of available comfort and the environment can stimulate students attention and acceptance towards the teacher. The issue of students overcrowding and too many students in a classroom are the problem that private institutions encounter. Sometime in one class it needs to accommodate and cater many students and it will make students feel uncomfortable during their learning process. Some private institutions only have a small building for their institutions and they only have very limited class. Because of excessive intake of students, the class for the students is not enough and they need to locate many students in a small class. In this case to reduce this problem, private institutions should limit their students intake and provide more classes for the learning process. Some priv ate institutions do not have enough places to allocate class because of small building. The third problem that private institutions face is in term of training. Most lecturers and staff in private institutions have less qualification and experience compared with the public institutions lecturer. Lecturer that was hired in private institutions usually less of teaching technique and some of them do not have qualification in teaching courses. Lecturer in private institutions usually only have degree qualification and only a few of them that have masters qualification. When they do not have qualification and less of teaching technique, their teaching will be less effective compared to the lecturers from public institutions. Private institutions are difficult to hire the quality teachers because many teachers fear that there are not secure if they work in private institutions. They more prefer to work in government sector compared with the private sector because government will give them more benefits. Besides that, private institutions also can expel them any time they want . That is why only the teacher that do not get placement in government want to works in private institutions because of no choices. Some private institutions need to hired teachers that have low qualifications because the shortage of teachers. When they have less qualification teacher, students also will get less skill. The lecturer in private institutions also always changed several time for one subject. This is because, there are part time lecturers in these institutions and often have business to deal with. So a replacement lecturer will come in instead. Sometimes public institutions need to hire the instructors that make a teaching profession as their part time job. So, the exchanging teachers always happen and this is the problem that private institutions need to face. Usually, teachers who work part-time in private institutions are just to earn extra income. Private institutions need to take this type of teachers because of the shortage of teachers problem that they face. Some of the graduates from universities also tried to get a job as a teacher in private institutions because they know that the requirement to be a teacher in private institutions is easy. They usually come from the fresh graduates that have no experience in teaching. In addition when the teachers always change, it will make the learning process not goes smoothly and students will be confused due to many teachers with different teaching technique. The training also one of the problem that need to faced by the private institutions in terms of provide a qualification and experience teachers. CURRENT WAY TO ADDRESS THE ISSUES ALTERNATIVE WAY TO SOLVE THE ISSUES Based on these problems, an alternative ways to solve the issues should be taken immediately. To overcome the issues of the opportunity of students that learn in private institutions in getting job, the private institutions and the government should take an action. Private institutions should implements some steps to create graduates that are not only able to compete but also able to create job in the world of work. It means that, private institutions should provide a courses or program that trained their students to be an entrepreneurship like entrepreneurship courses like the public institutions do. This course will prepared their students in case when they finish their study and they do not get work. When they have the knowledge on how to build a business they can create their own job after they finish their study. This will avoid them from unemployment problem. Besides that private institutions should provide the education system that relevant with the progress of the needs from the world of work. It means that, the syllabus of education that was provided by the private institutions should suitable with the world of work nowadays. Private institutions must prepare their students to have a good communication skill and can master English well. When their students have a good communications skill it will give them opportunity in getting job compared with the students that cannot master English well. Because we know that, English is very important in our world of work nowadays. Private institutions also should ensure that the courses offered get recognition by the government. This is because when the courses that were taken by the student did not get recognition by the government, it is hard for the private institutions graduates to get work due to not recognized degree. Private institutions should make sure that all the courses that were provided get the recognition first by the government. Companies usually do not want to hire graduates who have qualification which is not recognized by the government. In order to produce graduates that have good communications skills, private institutions should provide well-trained lecturer to teaching there. They cannot hire the teacher according to the needs but they need to choose the best lecturers that have qualification. This is because, students that study in private institutions pay for it and they deserve to get the best services compatible with the money they spend for it. To produce good students we need to provide good teachers. Courses on career planning should be held for graduates in various fields in order to create a well-trained human capital. Private institutions should plan some courses for their students in order to provide a quality graduates in the work field. For example they organize a program like Career and Training Fair for their students. Program like this will introduce them on how to prepare for the job interviews. Some of them will get knowledge from this program. Government also should take an action in order to solve these issues of getting job among students in private institutions. Government should limit the opening of private institutions in our country. This is because too many private institutions that were establish and for sure graduation from private institutions also increases. To avoid too many unemployment graduates, government should limit the approval from private agencies to open their private institutions. We can see nowadays the dumping of private institutions in our country compared with the public institutions. The intake of students to enter private institutions also should be limited in order to solve the issues of unemployment graduates. Government should issues the number of students that can be taken by private institutions each year so they know how much students they can take. Private institutions should take the students based on the conditions specified by the government. Besides that, government should ensure that private institutions take the qualified instructor to work there. Government should set the conditions required by all universities in order to take their instructor to teach there. Oedipus the King: Unrealistic or Realistic Essay -- Oedipus the King

Oedipus Rex – Unrealistic or Realistic  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚        Ã‚   Let’s explore the traces of realsim and its opposite in Sophocles’ tragedy, Oedipus Rex.    The first obvious question is: How can this drama possibly be considered realistic since it relies so heavily on predetermination and fate in the life of the protagonist, Oedipus? As Jocasta recounts to Oedipus:    An oracle Once came to Laius (I will not say 'Twas from the Delphic god himself, but from His ministers) declaring he was doomed To perish by the hand of his own son, A child that should be born to him by me.    Charles Segal in Oedipus Tyrannus has a solid rebuttal to what appears predestination:    The issues of destiny, predetermination, and foreknowledge are raised as problems, not as dogma. How much control do we have over the shape of our lives? How much of what happens to us is due to heredity, to accidents, to sheer luck. . . . These are the questions that the play raises, and it raises them as questions. It shows us men and women who are both powerful and helpless, often at the same moment. Oedipus embodies the human condition. . . . (75-76).    If this critic is correct that Oedipus embodies the human condition as it really is, then he is totally representative of reality, and not unrealistic as it might appear on first reading. Lennie and George in Of Mice and Men by John Steinbeck Essay

Lennie and George are considerably different from the other ranch workers mainly unlike the workers who are all shown to be lonely, George and Lennie have each other. They relay on each other and their dreams together. There is a bond of trust and friendship between the two main characters which is tragically highlighted in the closing lines of the novel. The novel ‘Of Mice and Men’ by John Steinbeck is set in the early 1930’s following the collapse of the New York wall street market known as the depression years. In this time there was heavy unemployment; migrant workers from all over America came to California where the novel is set in the Salinas valley in search of prospects of work. The ranch itself is a microcosm of the life for migrant workers in that time, their insecurities are shown through the characters such as Curley, Candy, Curley’s wife and also the life of Black people through Crooks. All the characters are lonely except for Lennie and George who have each other and this is shown through their hopes and dreams. Lennie and Georges history together opens up when George talks to Slim a character that everyone respects, even Curley. George openly speaks to Slim about the incident when George tells Lennie to jump into the river jokingly, but to everyone’s surprise Lennie jumps in without questioning George not realising he cannot swim and almost drowns if George didn’t rescue him, even then Lennie thanks George for saving him even though it was George who told him to do it in the first place. At this point George’s fear is shown at Leannie’s inability to comprehend logical and illogical things, George realises at that moment that if he is not careful Lennie could do the wrong thing again. George’s other fears are also shown in the incident at weed, while talking about it to slim he describes Lennie being ‘slow’ as he likes to touch everything he likes, just wants to feel it. So he reaches to feel a girls red dress and the girl screams, Lennie gets scared all he can think to do is hold on and that George had to hit him with a fence picket to make him let go. Again Lennie’s strength becomes an issue and the writer almost foretelling the future. George is afraid of Lennie not understanding right from wrong and his strength scares George making him think that he might to  what he did at weed again. Lennie is shown to be a child in a mans body . throughout the book he wants to be told their dream almost like a bed time story and doesn’t feel closure until he has been told it. And again like a child he likes soft and fury things relating to the reason why he likes to touch dresses. Lennie’s greatest fear of the all is that he won’t be able to tend the rabbits if he did something wrong like the incident at weed again, he is also afraid of his own strength and not being able to let go. Lennie and George’s dream of having a place of their own ‘living of the fat of the land’ and Lennie and his alfalfa patch and tending the rabbits, keep’s them going and hoping that they won’t have to worry about Lennie doing the wrong things again, and George being able to do what he wants do and not think about what will happen to Lennie. Their dreams create hope for other characters like Candy and Crooks even for a short while. On the face of it, it appears that Lennie, because of his mental immaturity, is totally reliant upon George for his survival and for obtaining work at various ranches. Equally important however, is the extent to which George relies on Lennie for companionship in the generally unfriendly and lonely environment of the migrant labourer. As George admits to Slim when discussing himself and Lennie ‘it’s a lot nicer to go around with a guy you know’. It can be seen; therefore that George might not be with Lennie purely out of a sense of pity or duty to Lennie’s aunt Clara. From the start of the novel Steinbeck raises the questions in the minds of the reader about why these characters should be involved in such an unlikely partnership: George is short of stature, intelligent and projects self-confidence, Lennie on the other hand, is a giant of a man, ponderous in his gait and his mind of a young child. The course of events that unfold are tragic, most of it starts with Curley and his insecurity about his height and his always willing to pick a fight with bigger men to prove he is not weak. Steinbeck calls him calculating and  pugnacious and gives him reptilian animal like qualities representing his behaviour to a crocodile while Lennie is shown to have bear and horse like qualities compared to animals with admirable traits. Ch 3 begins when Curley busts in looking for Slim who he thinks is with his wife. When Slim re-enters the room telling Curley that he’s sick of Curley asking him about his wife. Curley can’t fight with Slim so he moves to Carlson who warns him not to pick a fight with him, as they all join in Curley feels defenceless and so turns on to Lennie given any excuse to fight with him. As Curley begins to fight him, Lennie gives out a cry of terror and turns to George for help as he was too frightened to defend himself. George immediately gets onto his feet yelling ‘Give it to him Lennie, don’t let him do it’. George was afraid of Lennie’s strength but he wouldn’t let Lennie go down like that he was protective over him. As Curley goes for another blow to the blood covered face, Lennie grabs his fist. Curley is described to be flopping as a fish. Then just like in weed Lennie held on to the closed fist being crushed by Lennie’s hand. It took both George and Slim to make Lennie let go. Curley was warned not to say a word about what happened. After this Curley’s wife became very interested in what happened actually happened to Curley’s hand but nobody spoke to her. When Lennie kills the pup in the barn, while wondering what to do Curley’s wife comes in. even though he shouldn’t talk to her he does, she tells him how she is lonely and just wants someone to talk too, also how unhappy she is in her marriage to Curley, this is the only point in the novel where her story comes out, how she was never loved at home, how she married Curley to get away from her life, her dreams of becoming famous in movies. As Lennie feels her hair vents repeat themselves he can’t let go and in her struggle to get free and Lennie’s fear that she will call George he breaks her neck in attempt to silence her again his inability to control his strength has taken a turn for the worst. He realises what he has done and remembers that if he did anything bad George said to go to the brush where he’d find him there, so Lennie quickly and quietly leaves. Candy is the first to find her in the barn and gets George who knows instantly what has  happened he tells candy to let him go to the bunk house first then tell the rest of them so he doesn’t look involved. There dream is destroyed and candy blames Curley’s wife, when he tells the rest of them Curley shows no sign of remorse all he can do is think about getting Lennie back. As they all take off to find Lennie, George manages to find him first by the lake; even now he is still afraid he won’t be able to tend the rabbits. George knows that there is no way out for them, knowing Curley he would just want to kill him he wouldn’t put him in jail, and if he let him go the Lennie couldn’t look after himself he would die without food, shelter and someone to look after him. George knew that he would have to kill him when he found Lennie. Just like Candy’s dog to put him out of his misery for the sake of Lennie. Also he couldn’t let someone else do it he told Lennie about their dream one last time as he told it he quietly put the gun to the back of Lennie’s head without him realising and shot him, it was a sympathy kill.
